These General Terms and Conditions of Sale (hereinafter referred to as “GTCS”) govern all sales concluded on the kaylaparis.com website (hereinafter referred to as the “Site”). By placing an order on our Site, you unreservedly accept these terms and conditions.

Please read these conditions carefully before ordering.

KAYLA is a brand specializing in the creation and sale of handmade leather accessories, including leather belts and jewelry.

Article 2 – Purpose

The purpose of these General Terms and Conditions is to define the rights and obligations of the parties in connection with the online sale of products offered by KAYLA on the Site.

They apply to all sales concluded on the Site, to the exclusion of any other document.

Article 3 – Products

3.1. Product description

The products offered for sale are handmade leather accessories, including :

  • Leather belts
  • Leather jewelry (earrings, cuffs, chokers, rings)
  • Other leather accessories

Each product is presented on the Site with a detailed description including its essential characteristics (materials, dimensions, color, maintenance). The photographs illustrating the products are as accurate as possible, but cannot ensure perfect similarity with the product, particularly with regard to colors, due to variations in screen display.

3.2. Availability

Our products are offered while stocks last. If a product is unavailable after you have placed your order, we will inform you by email as soon as possible and offer you either a replacement product of equivalent quality and price, or a full refund of your order.

3.3. Handcrafted products

As our creations are handmade, slight variations may exist between products. These variations are part of the authenticity and uniqueness of each piece and do not constitute a defect.

Article 4 – Prices

4.1. Product prices

Product prices are quoted in euros (€), inclusive of all taxes (TTC), including the French VAT applicable on the day the order is placed.

Prices do not include delivery charges, which are indicated separately before the order is confirmed.

4.2. Price changes

KAYLA reserves the right to modify its prices at any time. Products will be invoiced on the basis of the prices in effect at the time the order is validated.

4.3. Price error

In the event of an obvious error in the price of a product (low price, comma error, etc.), KAYLA reserves the right to cancel the order and inform the customer, who will receive a full refund.

Article 5 – Ordering

5.1. Order process

To place an order, the customer must follow the steps below:

  1. Select product(s) and add to basket
  2. Check cart contents
  3. Enter delivery and billing information
  4. Choose your delivery method
  5. Choose payment method
  6. Check order summary
  7. Accept these terms and conditions
  8. Confirm order and proceed to payment

5.2. Order confirmation

After validation of payment, a confirmation email summarizing the details of the order is sent to the email address provided by the customer. This email constitutes acceptance of the order by KAYLA.

KAYLA reserves the right to refuse or cancel any order in the event of a previous dispute with the customer, suspicion of fraud, or an abnormal order.

5.3. Modification or cancellation

Any request to modify or cancel an order must be sent by email to contact@kaylaparis.com as soon as possible after the order has been placed. KAYLA will do its utmost to satisfy this request, without guarantee if the order has already been shipped.

Article 6 – Payment

6.1. Accepted means of payment

Payments can be made by :

  • Credit card (Visa, Mastercard, American Express)
  • PayPal

6.2. Payment security

All transactions are secured by SSL protocol (HTTPS). Payment information is processed directly by our PCI-DSS-certified payment service providers. KAYLA never stores your bank details.

6.3. Flow

Your credit card is debited when the order is validated.

6.4. Default of payment

In case of refusal of payment by the banking institutions, the order will be automatically cancelled and the customer will be informed by email.

Article 7 – Delivery

7.1. Delivery zones

KAYLA delivers worldwide. Delivery costs and times vary according to destination.

7.2. Delivery costs and times

Delivery costs are calculated according to geographical zone and are indicated in the basket before the order is validated. Delivery times are estimated and run from the time the order is dispatched.

7.3. Order tracking

A tracking number is sent by email as soon as the order is dispatched, enabling you to follow the progress of your parcel in real time.

7.4. Receipt of order

Upon receipt, the customer is invited to check the condition of the package and the products. In the event of a damaged package or missing/defective product, the customer must contact KAYLA within 48 hours.

7.5. Customs duties

For deliveries outside the European Union, customs duties, import taxes and clearance fees may apply. These costs are the exclusive responsibility of the customer.

Article 8 – Right of withdrawal

In accordance with article L.221-18 of the French Consumer Code, you have a period of 14 calendar days from receipt of your order to exercise your right of withdrawal, without having to give any reason or pay any penalty.

8.1. Return conditions

To be eligible for a return :

  • The item must be unworn, unused and in perfect condition.
  • It must be returned in its original packaging, with all labels intact.
  • Custom-made or personalized products (special orders) cannot be returned, in accordance with article L.221-28-3° of the French Consumer Code.

8.2. Return procedure

To make a return, please follow the steps below:

  1. Contact us via our contact form or by email at contact@kaylaparis.com to notify us of your return request.
  2. We will send you the return address and a form to include in the parcel.
  3. Return the product within 14 days of notification of your wish to cancel.

You are responsible for return shipping costs, except in the case of an error on our part or a defective product upon receipt.

8.3. Refund

Once the product has been received and checked, we will refund the amount of the returned item (excluding initial delivery costs) within 7 working days, via the payment method used at the time of purchase.

Article 9 – Returns and exchanges (excluding returns)

9.1. Defective or non-compliant product

If you receive a product that is defective or does not conform to your order, please contact us within 48 hours of receipt at contact@kaylaparis.com with :

  • Your order number
  • Photos of the product and the defect
  • A description of the problem

After verification, we will offer you an exchange or a full refund, including return postage.

9.2. Exchange

Exchanges are possible subject to the availability of the desired product. If the product is no longer available, a refund will be made.

Article 10 – Warranties

10.1. Legal warranty of conformity

In accordance with Articles L.217-4 et seq. of the French Consumer Code, KAYLA is obliged to deliver a product that conforms to the contract and is liable for any defects in conformity existing at the time of delivery. This guarantee applies for 2 years from the date of delivery.

10.2. Hidden defects warranty

In accordance with articles 1641 et seq. of the French Civil Code, KAYLA is liable for any hidden defects in the item sold that render it unfit for its intended use, or that impair this use to such an extent that the buyer would not have purchased it, or would have paid a lesser price for it, had he or she been aware of them.

10.3. Implementation of warranties

To invoke these warranties, please contact us by e-mail at contact@kaylaparis.com, describing the defect and enclosing photos if possible.

Article 11 – Liability

11.1. Responsibility of KAYLA

KAYLA is committed to supplying quality products that conform to their description. We shall not be held liable in the event of :

  • Failure to follow product care instructions
  • Normal product wear
  • Inappropriate or abnormal use of the product
  • Product modification by the customer
  • Force majeure or act of a third party

11.2. Limitation of liability

In any event, KAYLA’s liability is limited to the amount of the order concerned.

Article 12 – Intellectual property

All elements of the Site (texts, images, logos, photographs, videos, designs) are the exclusive property of KAYLA or its partners and are protected by French and international intellectual property laws.

Any reproduction, representation, modification, publication or adaptation of all or part of the elements of the Site is strictly forbidden without prior written authorization from KAYLA.

KAYLA collects and processes your personal data in accordance with the General Data Protection Regulation (GDPR) and applicable French legislation.

Article 15 – Mediation

In accordance with article L.612-1 of the French Consumer Code, in the event of an unresolved dispute with our customer service department, you may have free recourse to the consumer mediation service.

Article 16 – Applicable law and jurisdiction

These terms and conditions are governed by French law.

In the event of any dispute relating to the interpretation, performance or termination of these GTS, and failing amicable resolution, the French courts shall have sole jurisdiction.

However, in accordance with European regulations, consumers residing in a member state of the European Union may bring any dispute relating to these GTCs before the courts of their country of residence.

Article 17 – Modification of the GCS

KAYLA reserves the right to modify these GTC at any time. The applicable GTC are those in effect on the date of the order.

Article 18 – Partial nullity

If one or more of the stipulations of these GTC are held to be invalid or declared as such in application of a law, regulation or following a final decision of a competent court, the other stipulations will retain all their force and scope.
